Lindsay Lohan Fails Another Alcohol Test

Lindsay Lohan is in the news again. The conditions of her probation state that she is to remain alcohol and drug free while under house arrest, but a recent drug test showed that she tested positive for alcohol. So back to court goes Lindsay, as the world waited with bated breath to see if this time the young actress would get the punishment that anyone else would receive for multiple violations of probation.

Apparently not. The judge did not renew the requirement that Lohan undergo random drug and alcohol tests, so the fact that she had apparently been drinking didn’t result in any further punishment – even though Lohan herself seemed to feel that drinking alcohol was wrong because one of her supposed arguments against the failed test was that she drank fermented tea. The drug test requirement lapsed back in February – the same time that Lohan was arrested for stealing a necklace, another infraction that she was not punished for.

The judge who heard the issue of the failed alcohol test was not the same judge who order the house arrest. Said the judge: “I am not happy about house arrest. It was not my sentence.”

It turns out that the fact that Lohan had been hosting roof parties during her house arrest came to light during the court proceedings. The judge called that particular decision “extremely poor judgment” but went on to point out that “poor judgment is not a violation of your probation.” She did, however, go onto order that those parties stop, telling Lohan that she was allowed to have one friend visit her at a time.

Since the hearing, Lohan was not only released from her failed alcohol test but she also recently completed her house arrest term, a program put into place to allow nonviolent offenders to serve their time without adding to the overcrowding of the prison system. Despite two drunk driving convictions, a tone of probation violations, and the recent necklace theft, Lohan only had to serve 20 percent of her sentence. Her next focus in terms of recompense for very bad choices related to alcohol abuse: 480 hours of community service.

Some say that the root of all Lohan’s problems is alcohol abuse and addiction and that without treatment, she’ll continue to have legal troubles. The judge doesn’t agree: “She’s got other problems for which she self-medicates.”

Though she’s spent a total of eight months in drug and alcohol rehab programs, Lohan has continued to struggle with substance abuse issues.
